What is an appeal and why do I need a lawyer?
The decision made by the judge in the lower court may be appealed to an appellate court and then a supreme court if the losing party is unhappy with the outcome in the case.
An appellate lawyer must work with what is already on the record in the lower case (ie. preserved for appeal) and must make an argument within much smaller confines than in the lower court. The process is very technical because there are many procedural and substantive hurdles the lawyer must overcome to have the case reversed.
Our attorneys have the expertise to overcome these hurdles. We are able to advocate your case before a state or federal appellate court, including state supreme courts and the United States Supreme Court. We seek to correct errors of the trial judge by persuading the appellate court to overturn the lower court's decision or to expand or change the interpretation of statutory law.
We are very knowledgeable about the specific judges on the appellate panels and how they tend to lean for any given issue. Our Colorado cannabis attorneys have appealed many marijuana cases to the Tenth Circuit Court of Appeals, and feel very comfortable with each judge and his/her stance on the issues, especially with regard to tax, 280E, and constitutional issues.
